Data Consent
(the “Client”) acknowledges that, in order to make data review more efficient and effective, Archipelago Marine Research Ltd. (“Archipelago”) will be introducing Artificial Intelligence (AI) tools into its data review workflow. To develop those tools, Archipelago requires ongoing access to large volumes of fisheries data, including data collected from its clients.
For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Client agrees as follows:
Archipelago may collect, use and store electronic monitoring data collected utilizing Archipelago’s hardware and software tools on Client’s vessel (the “EM Data”): (a) to provide the electronic monitoring services, and (b) for its internal business purposes, in order to improve its services, provide more robust monitoring tools, and reduce the future costs of monitoring programs. Specific uses may include:
Program assessment and improvements
Development and refinement of program tools
Development and training of Artificial Intelligence (AI) and Machine Learning algorithm
Archipelago may disclose the EM Data to its development partners focusing on AI and machine learning solely for the purpose of developing algorithms for fish monitoring programs. Prior to accessing the EM Data, all development partners will be required to agree in writing to the same data use restrictions and privacy considerations as Archipelago. Unless permitted under this Consent or required by law, the EM Data will not be shared with any other party, including any agencies, groups or organizations involved in or advocating for the regulations of fisheries or involved in fisheries management.
As between Client and Archipelago, Client is the exclusive owner of the EM Data. Any personal information collected by Archipelago will be used only in accordance with the Archipelago privacy policy available at www.archipelago.ca/privacy-policy.
Client may request access to its raw EM Data at any time upon written request to Archipelago. Archipelago will endeavor to provide a copy of the EM Data via hard drive or download link within thirty (30) days. Depending on the volume of data, there may be a fee associated with the access to the data to facilitate the request and prepare the data for access.
Client may withdraw its consent to Archipelago’s use of any personally identifiable information or information regarding Client’s vessel at any time upon not less than thirty (30) days’ prior written notice to Archipelago. Client acknowledges that withdrawal of consent may adversely impact Archipelago’s ability to provide monitoring services to Client, affect Client’s ability to use AI tools, and/or increase costs. Client personally identifiable information or vessel information retained on Archipelago’s servers will be deleted within thirty (30) days of receipt of notice that consent has been withdrawn.
Anonymization is the process of removing personally identifiable information from data sets, so that people, locations and vessel names whom the data describe remain anonymous. Archipelago will have the right to collect and use anonymized aggregate data derived from the EM Data to develop and improve the AI capabilities of Archipelago solutions, and for development, diagnostic and corrective purposes related to Archipelago’s products and services, and such anonymized aggregate data shall be the property of Archipelago.
